Chapter 1: The Regulatory Infrastructure

1. Regulatory Foundation

This chapter establishes the UAE's regulatory foundation through Federal Law No. 4 of 2000, which created the Securities & Commodities Authority (SCA).

The SCA operates as an independent public authority in Abu Dhabi with its own legal personality, full financial, and administrative independence. It is prohibited from entering into commercial activities, having private interests of its own in any undertaking, or owning/issuing securities.

4. Work through one reconciliation example

Imagine your older note says only: “The firm must notify the authority within two days.” This is a fictional incomplete note, not a quotation or a UAE reporting rule. It omits the event, the type of day, the responsible entity and any exception. Memorising the number cannot repair those omissions.

Your ledger would record the topic, the original claim, the applicable workbook section, the precise correction and a new test. If the source supports a specific obligation, restore its complete conditions. If you cannot find the source, quarantine the note; do not guess a deadline from a different reporting obligation.

Now test the repair by describing the triggering event and asking when the clock begins. Next change the type of notification and check whether the same source still applies. If you repeat the original number without inspecting the changed obligation, the note has not yet become a usable decision aid.

This method also works for non-numerical changes. A note may name the right participant but give that participant another body’s responsibility. Fix the actor-action relationship, not merely the spelling of the organisation.

5. Keep terminology changes separate from rule changes

Older material uses SCA; current UAE terminology uses CMA, formerly SCA. The UAE legislation establishing the authority provides the legal succession context. Preserve the original names in historical resolution titles and source references so readers can still locate them.

Do not run a blanket replacement and call the folder updated. A renamed body, a renumbered objective, a new examination window and a substantive change of obligation are different events. Each needs different evidence and a different edit.

For numerical notes, retain the unit and triggering event alongside the value. “Two days” is incomplete if you have lost whether the source means working days, settlement days or a period starting from a particular notification. If two sources disagree, preserve the disagreement in the ledger until resolved rather than choosing the more memorable number.

6. Close the audit with a usable revision pack

Your revised folder should contain a current objective index, retained explanations, visibly corrected claims and a small unresolved list. Archive the superseded working copy separately so you do not accidentally revise from it later. Keep the original evidence available for comparison.

Use three completion checks: every objective has a coverage status; every changed rule has a traceable source; every important repair has been tested with a fresh scenario. A clean-looking document without these checks may only be better formatted.

Finally, schedule a brief source check near the sitting. You do not need to repeat the entire audit if nothing relevant changed. Review new notices, affected objectives and unresolved items, then return to practice. The aim is a trusted set of notes you can actually use—not an endless updating project that displaces learning.
