- ملكية أصول الصندوق: ملك لمالكي الوحدات مجتمعين وليست ملكاً لأمين الحفظ أو المدير
- قيود الصندوق العام العادي: 10% من صافي الأصول لفئة مصدر واحد، 20% لجميع فئاته؛ 15% اقتراض، مع الاستثناءات المحددة
- الصناديق الخاصة: تقتصر على العملاء المؤهلين والمؤسَّسيين، حد 200,000 ريال لعملاء التجزئة
- أنواع الصناديق المتخصصة: مؤشرات، ETF، أسواق نقد (180 يوم)، مغذية، قابضة، حماية رأس المال، وقفية

يتناول هذا الفصل بالتفصيل الإطار التنظيمي الشامل لصناديق الاستثمار في المملكة العربية السعودية، والذي أرسته هيئة السوق المالية (CMA) بهدف تنظيم القطاع المالي وحماية المستثمرين. يبدأ الفصل بتعريف مدير الصندوق كونه الشركة أو الكيان المؤسسي المرخص له بإنشاء وإدارة صناديق الاستثمار، ويقع على عاتقه الالتزام التام بواجبات الأمانة تجاه مالكي الوحدات. يشمل هذا الالتزام التصرف بحرص ومهارة، والعمل دائماً بما يخدم المصلحة الفضلى لمالكي الوحدات، مع التأكد من دقة واكتمال شروط وأحكام الصندوق بحيث لا تكون مضللة. ومن ضمن مسؤولياته أيضاً طرح الوحدات، وإعداد القوائم المالية باللغة العربية بشكل نصف سنوي للصناديق العامة. ويفصل النظام بشكل صارم بين أدوار مدير الصندوق وأمين الحفظ، حيث يُشترط أن يكون أمين الحفظ كياناً مستقلاً تماماً، غير تابع للمدير أو مديره من الباطن، مع الاستثناء المشروط للصندوق المغذي، وهو ال…
